Wife denied protective order with divorce filing

While there are certainly scenarios where protective orders are necessary in a relationship, there are sadly also situations where one spouse will make false domestic violence claims -- or lie about the fear of abuse -- in order to try and get an upper hand in a divorce or child custody case.

Right now, that appears to be the situation between Hollywood film producer Bob Weinstein and his wife Anna Weinstein. In divorce papers, Anna Weinstein claimed to be in fear of "bodily harm" from her husband. However, a judge did not approve a request for an order of protection.

According to sources, the order of protection request was made when Anna Weinstein filed for divorce from Bob Weinstein. This divorce filing reportedly came after her family -- including her husband -- did an intervention on her regarding unhealthy issues they believe she has with alcohol.

As of now, a Supreme Court justice overseeing the divorce has issued a gag order, which means neither of the spouses can publically talk about the case.

The couple had married in 2000, and has two children together. Looking to the future of this divorce case, given the fact that Anna Weinstein's family had recently attempted to do an intervention related to her alleged issues with drinking, it will be interesting to see if this ends up playing a role in any future child custody decisions. After all, when it comes to making decisions regarding custody, a judge typically weighs the best interest of the children. If one parent is struggling with an addiction, one could argue that this would not be the best for the children to be subjected to.
